Terms of Service

Business identity. Upraising Donkey is a brand and business operated by Gil Plazafy, the registered business name. In these Terms, “we”, “us” and “our” refer to Gil Plazafy operating Upraising Donkey.

1. Our service

Upraising Donkey helps people create, edit, store, discover, licence and purchase spiritual or uplifting images, audio, video and related digital products. Features may include automated or artificial-intelligence-assisted tools. Some features may be experimental and outputs can vary.

2. Accounts and eligibility

You must be legally able to enter into this agreement. If you are under the age of legal majority where you live, a parent or guardian must approve your use. Provide accurate information, protect your credentials and tell us promptly if you suspect unauthorised access. You are responsible for activity performed through your account.

3. AI-assisted creation

You control the prompts and source material you submit. You must have the necessary rights and permissions to use them. Generated output may be inaccurate, unexpected or similar to content created for another user. Review output before publishing, selling or relying on it. Do not treat generated content as professional medical, legal, financial or religious guidance.

Where the law permits, you retain rights in your original input and receive the rights Upraising Donkey is able to grant in output created for you. This does not transfer rights owned by other people or make otherwise unlawful content lawful.

4. Marketplace

Marketplace listings may be offered by Upraising Donkey or independent creators. Each listing should identify its price, format and licence. Buyers receive only the licence described in the listing; ownership of underlying intellectual property does not transfer unless explicitly stated. Creators must describe work honestly and may list only content they have the right to sell.

5. Your content and our licence

You keep ownership of content you upload, subject to third-party rights. You give Upraising Donkey a limited, worldwide licence to host, process, reproduce and display that content only as needed to operate, secure and improve the service, fulfil your requests, and show work you choose to publish or sell. This licence ends when the content is deleted, except for reasonable backups, completed transactions and legal obligations.

6. Acceptable use

Do not use the service to break the law; violate privacy, publicity or intellectual-property rights; impersonate or deceive; exploit or sexualise minors; create hateful, harassing or non-consensual intimate content; distribute malware; bypass safeguards; scrape at disruptive scale; manipulate reviews or sales; or interfere with other users or the service. We may remove content or restrict accounts to protect people, rights and the platform.

7. Prices, subscriptions and refunds

Prices and applicable taxes are shown before purchase. By ordering, you authorise the displayed charge through the offered payment method. Subscription charges recur until cancelled and changes apply at the end of the current billing period unless stated otherwise. Eligible purchases have a 60-calendar-day refund and cancellation window from payment; digital downloads, including downloadable artwork and digital licences, are non-refundable except where required by applicable law; for physical products, the return window starts on delivery. See our Refund Policy and Cancellation Policy for full details. Cancelling renewal does not automatically refund past charges. Mandatory consumer rights remain unaffected.

8. Availability and changes

We aim to keep Upraising Donkey reliable, but do not promise uninterrupted access or permanent availability of every feature. We may update, limit or discontinue features for safety, legal, technical or business reasons. Keep your own copies of important work.

9. Disclaimers and responsibility

The service is provided “as is” and “as available” to the extent permitted by law. We do not guarantee that generated content is unique, accurate, fit for a particular purpose or free of third-party claims. Nothing in these Terms excludes liability or rights that cannot legally be excluded. To the extent permitted by law, Upraising Donkey is not responsible for indirect, incidental, special or consequential loss arising from use of the service.

10. Suspension and termination

You may stop using the service at any time. We may suspend or end access when reasonably necessary for serious or repeated violations, security risks, non-payment, legal requirements or harm to others. Provisions that by nature should survive—such as completed licences, payment obligations, ownership and responsibility limits—will continue.

11. Changes to these Terms

We may update these Terms as the service or law changes. We will post the revised date and provide additional notice for material changes when appropriate. Continued use after the effective date means you accept the updated Terms.
